Hi, the above mentioned article published by
Chris Wright/Dmusic is regarding an incident
between T666 and Mp3.com in 2001.
For your evaluation of Dmusic and its ‘support’
of independent artists refer below to the T666
Legal Demands Part 3, Defamation.
Result: T666 v Mp3.com
Mp3.com paid T666/Violent Entertainment the day
they received the legal demands from the
T666/Violent Entertainment Legal department. In
full payment was made for outstanding royalties
plus projected royalties for the period that the
T666 mp3 page was offline.
The T666 mp3 page was then also promptly
reinstated.

2. Breach of Contract
MP3.com has put T666's Artist page on hold and
forfeited the royalties earned by T666 under the
Promotion because it has claimed that T666 has
been disqualified from the Promotion because of
"deep-linking activity".
Deep linking is not "tampering" with or "gaming"
the Promotion. It is standard Internet practice
and drives users to the MP3.com website.
Therefore, MP3.com has breached the Payback for
Playback terms and conditions by placing the
Artist page on hold and forfeiting our royalties.
The Contract only provides for disqualification
if a member is found to be "tampering" with or
"gaming" the Promotion. There is no term in the
contract that prohibits deeplinking.
2. Breach of Copyright
In view of the fact that MP3.com put T666's
Artist page on hold, forfeited our royalties and
breached the Contract, MP3.com's continued use of
the Songs without T666's permission is an
infringement of copyright. MP3.com is only
entitled to use the Songs in accordance with the
Contract.
We believe we have a right to claim damages or an
account of profits for MP3.com's infringing
continued use of the Songs.
3. Defamation
We received a copy of an email sent to the editor
of Dmusic.com by Michael Robertson of MP3.com
which stated that T666 was "cheating".
Consequently, an article was published on
Dmusic.com entitled "T666 Involved in Cheating
Scam". In our view this is defamatory of T666 as
it implies that we were involved in fraudulent,
illegitimate activity. While we do not concede
that we operated in a "deeplinking activity",
deeplinking is not illegitimate, it is standard
Internet practice and does not breach the
contract.
